Company Policy for all Giftmugs and Bitmark, Inc. website.

(Please note that the section on returning mugs of the present guarantee does NOT apply to any of the decorations offered with PayPal payment by our sister web site: www.giftmugs.us as well as with our
PayPal Easy Ordering process, as on both, all sales are final.)

Should you not be happy with the sublimation-decoration of our own, (that is giftmugs' decorations as shown in our web site: www.giftmugs.com) full-color, custom-decorated ceramic coffee mug decorations as shown in our web pages, just tell us why and send them back to us, post-paid, in their original packaging material with the original invoice, insured and with tracking information as soon as we e-mail you our return authorization # and our return shipping address.
This guarantee is only valid if you advise us within 5 business days of arrival of your mug order at the original shipping address. No other guarantees and/or warranties are made, nor do we guarantee the longevity or our mugs. Minor color shifts are excluded from this guarantee (see below) as they are a normal byproduct of the decorating process.

We'll then decorate new mugs for you for free for every original, undamaged mug that arrives here in perfect conditions. You only pay S&H, as shipping & handling charges are, as always, not included in our guarantee and are not refundable either. 

Mugs will not be accepted for returns without our prior return authorization number nor can we honor requests for refunds All authorized returns must be shipped freight pre-paid, with valid tracking information/numbers and be fully insured.  By returning any mug(s) to us you expressly authorize us to automatically charge your credit card  for the S&H portion resulting from the shipment back to you of any replacement mug(s). You specifically agree that you'll not contest these S&H charges.  Mugs returned that to not meet these conditions will not be accepted. We are not responsible for lost or stolen packages.

Mugs decorated partially or totally with YOUR digital art (which you sent us), or mug decorations that include YOUR digital artworks and/or lettering, even if only as part of a decoration, are not returnable as we have no control over spelling of text, personalizations, the quality, resolution and dimensions of your digital art which we reproduce on our mugs just as you sent it to us, that is, we decorate our mugs with your digital artwork AS IS and in the dimensions and resolutions you sent it to us.

To assure that you send us the best possible digital artwork and in the dimensions and resolution required, you might want to consult our suggestion pages as well as our Frequently Asked Questions (FAQ) page and our listing of the maximum dimensions that can be put on our coffee mugs as decorations.

Small image misalignments on mugs are unavoidable as not all mugs are perfectly cylindrical causing the "misalignment", as well as some minor streaking on large, dark background areas and small, light lettering on dark backgrounds that tend to "leak" are unavoidable and are not covered by our guarantee as well as small color shifts. You might want to consult our tips on reverse type section on this subject.

As always, the virtual mug layout we submit to our customers for "order confirmation" purposes is NOT for the purpose of "checking" the color but to show, in general terms, the layout of the art work and what the mug might look like. We're not color perfect by any means and variations from intended colors and tones have to be accepted. Should color fidelity be of primary interest, then you should first order a sample mug

All shipping and handling charges are excluded from our guarantee, including our own rush charges that may be part of Express and overnight shipments, as we have no responsibility over the acts of shippers for eventual delays and/or damages. We are not responsible for lost, destroyed, misdirected or incorrect information provided to us by our customers.

Declared Value and Limits of Liability (Not Insurance Coverage) as offered by the respective carrier.
We use the services offered by the respective carrier or shipping companies with regards to any shipment with a customer-requested declared value. Giftmugs itself does not insure any shipments as we only use the services offered by the carrier(s) to the public at large. Hence, for more details on this our customers will have to consult the company policies of the respective carrier. If we ship your order with FedEx, then please consult here for details.  Shipments with USPS will fall under USPS conditions.

For declared value mug shipments and/or non-delivered packages, the customer has the obligation to file a claim directly with the respective transportation company/carrier - in most cases with Federal Express or with the US Post Office - submitting to them the complete mug shipment, our invoice, and the entire packaging material. 
We'll not accept any returns of mug shipments, damaged, broken or otherwise. It is the customers sole obligation to file a claim directly with the shipper/carrier. We are not able to decorate replacement mugs while the claims process is still ongoing. Any refund check received for your claim from the insurer will be forwarded to customer's credit card billing address supplied with the original order.

USPS shipments:
Orders shipped with USPS will receive automatic tracking information (when requested, ordered or available) directly from the e-mail client of USPS. All tracking information can be checked on the USPS website only. The USPS toll free numbers will not respond to these tracking numbers.
Tracking information will be sent to the e-mail address supplied by customer with order and it is the customers sole responsibility to make sure that any such e-mail from USPS (or any other carrier, to this effect) will not be blocked in any way nor be considered as spam by his/her e-mail client. Copies or duplicates of tracking information are not available.

Customer agrees to not hold us responsible for any package delivery that we addressed correctly to the address supplied by customer yet could not, or was not, delivered by the carrier (USPS, FedEx. etc). It is customers responsibility to inquire with USPS (or any other carrier) directly concerning the non-delivery of package and will hold us harmless. A re-shipment fee will be required before we'll re-ship any returned packages.

 

FedEx shipments:
Customer will file any claim(s) directly with FedEx
and we offer here only some convenience links to FedEx's web site for tips and help on how to best file a claim either directly over their web site, by fax or regular mail.

Our products - mostly ceramic coffee mugs and ceramic tiles - are fragile and some breakage should be expected during shipping. Claims for breakage must be filed directly with the carrier. Shipments are made F.O.B. our facilities in Melbourne, Florida, USA.

Please take note and remember that if a shipment cannot be delivered to the shipping address supplied to us on our order form and confirmed with our order confirmation, and an address correction is required either by giftmugs or by FedEx or other shipper, this address correction is subject to a $15.00 charge and will be charged to the original credit card account number supplied by customer. It is expressly understood and agreed that customer will not contest such a charge to the supplied credit card under any circumstances.

FedEx shipments with customer's FedEx account number:
For all orders placed with the specific request to charge customer's FedEx account (also when customer supplies a FedEx account number with the order), it is understood, and customer agrees, that we can charge the supplied credit card should FedEx NOT accept customer's account or the account is declared "Cash Only" by FedEx. Customer will not dispute this credit card charge for shipping under any circumstances.

Title transfers the moment we deliver to the transportation agent and the customer will be the owner of the goods from that point on.
Responsibility for delivery and safe cartage rests exclusively with the carrier.
Claims for adjustments, breakage, non-delivery and delays must be filed directly with the carrier by the recipient/addressee, that is, by the customer or the designated recipient.

We reserve the right to adjust the prices submitted by the customer based on the mugs actually ordered and shipped - and not necessarily those quoted -  and we will also add the Florida Sales Tax, where applicable, without consultations with the customer. 

  • We reserve the right to demand payment in full on any job before starting production. 

  • We reserve the right to refuse any job/order received without any explanation.

  • Giftmugs by Bitmark, Inc. cannot be responsible for pricing or other errors, and reserves the right to cancel orders arising from such errors. 

  • We reserve the right to refuse to submit price quotes for any requests accompanied or not by high-resolution digital art work files  and/or for less than 36 mugs per design per order.

  • We reserve the right to consider any order as not serious for which more than one (1) identical digital image file(s) was submitted and might not confirm nor accept such an order without any further explanations. Such order will be considered spam by us and deleted from our systems.

  • We reserve the right to use, in our advertising and web sites, any items we receive, produce and decorate, unless you specify otherwise, in writing, at the time you place your order. 

  • We also reserve the right to use any and all unsolicited material --  e-mails, digital art works, digital files, photos, patches, etc. --  sent to us as we deem appropriate and might use it in our promotions.
    Any unsolicited material sent to us will only be returned if accompanied by self-addressed, postage pre-paid, insured and trackable, appropriate return mailer.

  • All our pre-designed mug decorations are offered AS IS and we are not responsible for possible color deviations or color shifts from those shown in our web pages. Should color be a critical element, please order a sample mug first to assure that the colors meet with your requirements. Orders placed without first having ordered a sample mug are not covered under our return policy - see above.

  • Customer-submitted hard copy material such as photos, drawings, patches and/or similar paper-based or fabric art works and patches will be returned only with the finished mug order shipment and if specifically requested by the submitter in writing. Any other returns will be charged a $15.00 handling and mailing fee. This fee also applies if no mug order results and/or if our Order Confirmation is not accepted.

  • Instructions and details submitted to us by letters, fax or any other paper-based medium will not be considered by us as we can only recognize as valid information submitted with our on-line order form and order-specific e-mails.

  • Giftmugs does not accept ideas, concepts, or techniques for new services or products through giftmugs.com or any other of our web sites.  If such information is received, it will not be considered confidential and Bitmark, Inc. will be deemed free to use, communicate and exploit such information in any manner it chooses.

  • There will be a $40 charge for all NSF checks and/or checks returned for any reason.

  • Gift Mugs by Bitmark, Inc. is not responsible for any failure of visitor/customer to receive e-mails in connection with any order due to non working e-mail address or any sort of a spam filter or other restrictive features on customer/visitor's side. This also applies to any tracking information that is sent to customer-supplied e-mail address(es) either directly from the respective shipper(s) or ourselves.

  • IMPORTANT!
    We'll not be responsible for e-mails sent to us that do not have an appropriate subject line containing at least one of the words: mugs, giftmugs, gift mugs, photo mugs, custom mugs, Bitmark, or similar description; nor for any Order Confirmation you sent back to us as your approval of it with a changed or non-existing subject line, as our anti-Spam programs might eliminate all e-mails not meeting above requirements.

  • We reserve the right to not prepare any Order Confirmations for customers that indicated on our order forms that they have not consulted our price list or are not familiar with our prices.

  • There will be a $25.00 digitizing charge for any orders received via fax, letter or similar hard copy.

  • We do not honor any phone orders and all information with respect to any mug order has to be in writing via e-mail - without exception - from a valid and verifiable e-mail address in the header of any e-mail message (and not in the body of it).

  • We do not guarantee timely arrival of your Gift Mugs order, only timely shipment from our plant under normal conditions.

  • Once orders have been accepted by the customer by returning our "signed" Order Confirmation, no further changes can be made to the order and/or designs/decorations and the order is irrevocable and can no longer be changed, and customer expressly agrees that he/she will not contest the resulting charges as indicated in our Order Confirmation (also consult here).

  • Orders placed in December might not arrive in time for the holidays. It is the customer’s responsibility to determine estimated delivery times before selecting a shipping method and submitting an order.

  • Our facilities shall be closed for five (5) consecutive days, starting with December 22.

  • We observe all legal holidays.

  • We reserve the right to not confirm any order(s) submitted with an incomplete or contradictory order form.

  • Our response to e-mails will only be directed to the e-mail address given in the header of the e-mail and not to those addresses that might appear in any e-mail within the body of the e-mail message.

  • If we do not receive a response to our Order Confirmation (and/or request for Fax authorization for orders to be shipped to addresses other than those indicated on the credit card) within 7 calendar days of having sent it to the e-mail address indicated by the customer, we consider this absence of response as abandonment of the order placed and hence cancelled.

  • Any indication of size of our gift mugs (for example: 11-oz mug) is only indicative and cannot be construed as indicating the precise size or capacity of any given mug. These indications only serve as identifying means and serve no other purpose as our mugs are not measuring cups. (Note: Since we buy our blank, undecorated coffee mugs, we have no influence over the precise "fill capacity" of each mug and are, therefore, offered AS IS.)

  • Customer is solely responsible for any use made with our coffee mugs as we have no control over how our mugs might or are treated. Like any other ceramic ware, our ceramic mugs are breakable and should not be exposed to rapid temperature changes. Our full-color sublimation decorations should be limited in the exposure to direct and prolonged sunlight to avoid and minimize excessive fading.

  • Due to the extreme difficulties inherent in the production and decorating process of our Morph or Chameleon coffee mugs, small irregularities have to be accepted as normal, as well as the Morph color density and coverage of the Morph mugs themselves.

  • Problems/Questions must be submitted on-line via the
    Customer Service Action Form
    for proper documentation.
    Phone submissions or regular e-mails to this effect will not be considered
    nor can be accepted under any circumstances and will be considered as non-existent.

  • To preserve the beauty and vibrancy of the image on our full-color sublimation-decorated mugs, it is best to hand wash them as you would hand wash any fine China as well as your best glasses. Also, never leave the mugs in direct sunlight, for example on a window sill. Never leave an empty mug on a heating plate or any source of heat! (also consult here).

  • Credit Card Disputes:
    If a User disputes a credit charge, Gift Mugs by Bitmark, Inc. reserves the right to charge said User a $25.00 service charge for investigative purposes if we find the charge back has no basis (also consult here).

  • Shipping with customer's FedEx account number:
    Should FedEx not accept the account number submitted by customer for any reason for the shipment of his/her order, customer expressly authorizes us - and will not challenge this charge - to charge the submitted credit card for the total amount of our Order Confirmation. Furthermore, customer also expressly authorizes us - and will not challenge this charge either - to charge the submitted credit card for the resulting shipping charges as indicated in our Price List for the shipping method indicated by the customer with his/her order.

  • We are not responsible in any way for any tracking information that may or may not display in the respective shipper's tracking web page.

  • Shipping & Handling Charges:
    The shipping and handling charges were established by taking the average delivery charges for products. These charges include processing, packaging, warehousing, delivery to shipper, customer service, and various other charges.  
    Additional charges apply to: Priority Shipping, Rush Shipping, International Shipping, and Re-shipping (due to User's error or refusal to accept package - also see below.) Please also Read this!

  • We reserve the right to ship either with FedEx Saver or USPS Priority Mail, regardless of the shipping method confirmed by us to customer, no matter if customer requested FedEx Saver or USPS Priority Mail.

  • Packages sent to third parties and returned to us as being not deliverable by the shipper, will not be re-shipped by us unless the ordering customer instructs us in writing to send the non-deliverable package to a new address. Customer will not contest any resulting shipping charges charged to his/her credit card submitted with original order.

  • Any claims of order or delivery shortage will have to be communicated to us by e-mail by the person having placed the original order within two (2) business days of delivery date (as indicted by shipper) to be considered.

  • Should customer not contact us with respect to the not-delivered mug order within 30 calendar days from ship date, the package will be considered abandoned and discarded by us without any prejudice. If shipper informs us that your order is not deliverable, we have no further obligation and will not try to find an address that works.

  • Tracking Information:
    - For customers who decline to have their packages tracked on the Internet or otherwise, or where tracking information is not available (as for USPS international air parcel post packages and similar, for example) we're not able to provide any assistance should the package not arrive at its destination, arrive damaged or be in any other irregular condition.
    Should tracking information for international shipments be required by the customer, any of FedEx's international shipment options should be considered and so indicated when placing your order with giftmugs.
    - Customers who specifically requested tracking information (and indicated a shipping method that generates tracking information) will be e-mailed the corresponding tracking number to the e-mail address supplied with the original order. Once we have e-mailed this tracking number to the customer, giftmugs will no longer be responsible for the shipment and all questions and/or claims have to be directed to the particular shipper by the recipient or person placing the order.
    - It is the customer's sole responsibility to present any questions and/or claim(s) directly to the corresponding carrier/transport company.

  • We are not responsible in any way for any tracking information that may or may not display in the respective shipper's tracking web page.

  • Since tracking information is sent directly from the shipper's server, we're not able to resend it It is our customer's responsibility to make sure that their e-mail client accepts e-mails originating from USPS as well as FedEx.
     

  • Re-shipments:
    Customer is responsible for a re-shipping charge of $15.00 plus any normal S&H charges if package is:
    -  returned undeliverable due to customer's error;
    -  and/or addressee refused acceptance of shipment for whatever reason;
    -  and/or if the phone number you supplied with your original order is not valid.

  • FedEx Ground Claims:
    If any FedEx Ground package should arrive damaged or not arrive at all,
    it is the recipients obligation to file a claim directly with FedEx.
    A claim form can be obtained from them by calling: 1-800-463-3339. Please note that FedEx Ground settlements are issued to the claimant, which in this case is you, our customer. Please also consult here for details.

    We'll not be able to file a claim on your behalf but will assist you - as much as possible - with any information that might be required for the filing of the claim.
     

     

  • Mug Differences:
    Small differences from mug to mug have to be accepted as different mug manufacturers offer slightly different mug models and mug finished within the same mug class and size class.
    Hence differences in finish, surface gloss, mug color, surface color, surface appearance, handle size, handle shape, mug size mug dimensions, as well as any other small changes have to be expected and are treated as acceptable.
    On occasion, we might have to complete an order with mugs manufactured by different suppliers and hence the mugs in that order might not all be the same. Should this be of importance to you, then you'd have to indicate your preferences in your original order as otherwise we'll complete orders with the mugs available to us at the time of order arrival.

Our sublimation mug coating meets FDA requirements for resinous coatings intended for food contact surfaces. Our mugs are white-glazed and are dishwasher and microwave safe. However under certain circumstances and conditions, mug decorations may fade prematurely and might also not be as dishwasher resistant as one might expect, as all our mugs are digitally decorated with the full-color sublimation decorating process. This decorating method is not the same as mug decorations based on vitrifiable decals (the decorating process used with off-set or screen-printed ceramic decals with the traditional spot-color and/or the 4-color process printing). Based on this, some fading might occur which has to be accepted as the present state of the art has not yet been able to eliminate this problem completely. Thus, we cannot guarantee the color fastness of the mug decorations.

In order to be able to deliver custom decorated coffee mugs with optimum quality decorations and to reduce to a minimum customer disappointment with the reproductions of their own digital artworks on our white-glazed ceramic coffee mugs and our frosted glass beer steins, we again summarize here the minimum requirements for customer supplied digital raster or bitmap artworks (this does not include vector artworks as all vector images are resolution independent):

- Image Resolution: 300 dpi's (dots per inch), and NO ".gif" or ".doc" files

- Image Dimensions: as they are to appear on the finished mugs or larger;

- Image Color Density: Image Color Density: lowest percentage of any color: about 15-20%;

We always use customer-submitted digital art AS IS and do not modify or change it;

We cannot offer free help with the preparation or creation of digital files. Our FAQ pages and Help sections on how to create digital images are the only free services we can offer at this time.

Product Warranty: Only such warranties as are made by: the manufacturers of the blank ceramic coffee mugs, the sublimation mug coatings, and of the sublimation inks used with our decorating process, are available to the Buyer. SELLER MAKES NO WARRANTY OF ANY KIND, WHATEVER, EXPRESS OR IMPLIED; AND ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE IS HEREBY DISCLAIMED BY THE SELLER. Seller shall not be liable for any consequential damages, loss or expense arising from the use of or the inability to use the goods for any purpose whatsoever.


Sponsorships.
Due to the many sponsorship requests we receive, most e-mail requests will not be answered, nor do we guarantee support of any event. In addition, giftmugs by Bitmark, Inc., is not sponsoring any clans and/or family related events or sending out product donations for events.
